KSA Identifies Major Flaws in Online Gambling Risk Assessment System

KSA Identifies Major Flaws in Online Gambling Risk Assessment System

The Dutch Gambling Authority (KSA) has identified serious problems with the current risk assessment system used by licensed online gambling operators. A recent investigation found the process is inconsistent, expensive, and provides little real player protection.

Current System Problems

The KSA examined how operators assess risks in their game portfolios. The review found five different assessment methods being used across the industry. This lack of standardization creates major problems.

Even when the same games are assessed by different operators, results vary significantly. Sometimes the same external party produces different results for identical games. This makes it impossible to compare risks across the sector.

Most operators conduct assessments at category level rather than individual games. This means high-risk games can be underestimated when grouped with safer titles. Current regulations don’t specify how assessments should be conducted.

Duty of Care Requirements

When Netherlands opened its online gambling market in October 2021, strict player protection measures were introduced. These "duty of care" obligations require operators to take active steps to protect players.

Risk analysis of every game portfolio is mandatory. The goal is identifying potentially harmful games and introducing additional protective measures. However, the KSA investigation shows this system isn’t working effectively.

Need for Reform

The KSA concluded that operators invest considerable time and resources into risk assessments with minimal added player protection. The regulator is now working with the Ministry of Justice and Security to improve the system.

The goal is creating a clearer, uniform framework for consistent risk assessments across the industry. This should strengthen consumer protection while reducing operator costs and complexity.
