A federal court in São Paulo has granted Stake Brasil a partial preliminary injunction against Provisional Measure (MP) No. 1,394/2026, Brazil’s nationwide ban on fixed-odds betting, the operator said in a statement. Until 25 October 2026, its authorisation stays valid and its stake.bet.br site and domain cannot be blocked or redirected.
What the injunction covers
The 9th Federal Civil Court of São Paulo issued the decision, according to Stake Brasil. The operator said that until 25 October 2026:
- its authorisation remains valid;
- the stake.bet.br site and domain may not be blocked or redirected;
- no sanction may be imposed on it for operating within the conditions set by the decision.
Stake Brasil said it has complied with the obligations imposed since the MP was published and will keep complying with both the MP and court determinations. The operator said it remains at the disposal of the authorities.
Stake’s reading of the ruling
Stake Brasil framed the decision as a statement on legal certainty for licensed operators.
“By recognizing that an authorization obtained by fulfilling all legal requirements, paying the grant fee, and making significant investments confers a legal position that cannot be suppressed without due consideration, the Court reaffirmed the importance of legal certainty and the stability of rules,” Stake Brasil said in its statement.
The operator also said it is the first licensed operator to obtain a decision of this kind, adding “to our knowledge” to the claim. It argued that consumer protection is one of the main benefits of a regulated market, with clear rules, responsible gaming mechanisms and oversight by public authorities.
The MP behind the case
President Luiz Inácio Lula da Silva issued MP 1,394 on 25 September 2026. Under Article 1 of the text published by the Planalto, the exploration, offer, intermediation and advertising of fixed-odds betting lotteries are banned nationwide, online and offline.
Article 4 extinguishes existing authorisations 30 days after publication, which is 25 October, with no refund of the grant fee and no compensation. Article 23 lets the Ministry of Finance and the Ministry of Justice request that sites offering the lotteries be blocked or redirected. The Secretariat of Prizes and Bets (SPA) published an explainer on the MP’s timetable, which set sites and apps to go unavailable from 6 October.

Next steps
The ban is also being tested at the Supreme Federal Court (STF). The Attorney General’s Office (AGU) has asked Justice Luiz Fux to keep the ban in force pending the PGR’s view, after the National Association of Games and Lotteries (ANJL) and the Brazilian Institute of Responsible Gaming (IBJR) asked for it to be suspended. Fux has not set a date for a ruling.
Stake’s protection runs to 25 October 2026, the date existing authorisations lapse under the MP. The MP loses force unless Congress converts it into law within 60 days, a period that can be extended once by a further 60.
