A Stake Brasil injunction against Provisional Measure 1,394/2026 has been granted by the 9th Federal Civil Court of São Paulo, the company said in a press release dated 9 October 2026. The partial preliminary ruling provisionally preserves the effects of its authorisation to operate fixed-odds betting in Brazil and remains effective until 25 October 2026.
Under the decision, Stake Brasil’s authorisation remains valid, its website at stake.bet.br cannot be blocked or redirected, and sanctions cannot be imposed on the company for operating within the conditions established by the court. To the company’s knowledge, it is the first licensed operator to obtain a decision of this kind.
Stake Brasil on the ruling
Stake Brasil said it views the ruling as an important signal for businesses operating under government authorisation and supervision. The company stressed the importance of recognising the legal position of operators that have fulfilled regulatory requirements, paid the applicable authorisation fees and made significant investments in the regulated market.
According to Stake Brasil, the decision reinforces the importance of legal certainty and regulatory stability, particularly where businesses have acted in accordance with the requirements established by public authorities.
Consumer protection
Stake Brasil said consumer protection remains one of the principal benefits of a regulated betting market. The company said it believes that clear rules, responsible gambling mechanisms and oversight by public authorities are essential to effective consumer protection.
Since the publication of the Provisional Measure, Stake Brasil has complied with the obligations imposed and said it will keep observing both the measure and the determinations of the judiciary.
Industry context
Provisional Measure 1,394 was published on 25 September 2026. Under Article 1 of the text published by the Planalto, the exploration, offer, intermediation and advertising of fixed-odds betting lotteries are banned in Brazil, in physical or virtual form, including when offered by foreign operators. Article 4 extinguishes existing authorisations 30 days after publication, which falls on 25 October 2026, with no refund of the grant fee paid under Law 14,790/2023 and no right to compensation.
The injunction runs to the same date. The ban is also being tested at the Supreme Federal Court (STF), where the Attorney General’s Office (AGU) has asked Justice Luiz Fux to keep the ban in force pending the PGR’s view. Under Brazil’s Constitution, a provisional measure lapses unless Congress converts it into law within 60 days, a period that can be extended once by a further 60.
