Brazilian lawmakers have filed 58 amendments to Provisional Measure (MP) 1,394/2026, which created the Brazil betting ban on online betting and games, and four have been withdrawn by their authors, according to the National Congress page for the measure. The window to file more amendments closes on 13 October 2026.
President Luiz Inácio Lula da Silva signed the MP on 25 September 2026. It prohibits the operation, offering, intermediation and advertising of online bets and games, according to Agência Brasil. The Congress page lists 23 November 2026 as the deadline for deliberation, with the urgency regime starting on 9 November.
Amendments to the Brazil betting ban
Senator Hiran Gonçalves (PP-RR) filed amendment 38, which would end the “tigrinho” slot game and other games of chance and allow only real sports events, according to its summary on the Congress site. Deputy Pedro Aihara (PP-MG) filed amendment 14, which bans betting on slot games and sets up an oversight committee.
Deputy Bruno Ganem (PODE-SP) filed amendment 6, which would send fines and tax receipts from irregular betting to the Ministry of Health for treatment of gambling addiction in the Unified Health System (SUS). Deputy Marcos Braz (PSDB-RJ) filed amendment 8, which bars recipients of federal cash-transfer programmes such as Bolsa Família from betting.
Senator Alessandro Vieira (MDB-SE) filed eight amendments (21 to 27 and 42). They cover sanction procedures, a Central Bank deadline, the oversight committee, bank liability for blocks, the crimes of operating or promoting online betting, and the use of fines for the national health fund and the national public-security fund.
Deputy Julio Arcoverde (PP-PI) filed amendments 28 to 33. Amendment 28 bans unauthorised operators, including those based abroad that serve people in Brazil. Amendment 29 states that ending licences gives operators no right to a refund of the licence (outorga) fee or to compensation. Senator Jorge Kajuru (PSB-GO) withdrew three amendments on 2 October, including one that would have limited refunds to the value of the remaining licence period.
Stake and the court challenges
The National Association of Games and Lotteries (ANJL) and the Brazilian Institute for Responsible Gaming (IBJR) asked the Supreme Federal Court (STF) on 28 September to strike down the MP, with Justice Luiz Fux as rapporteur. On 8 October, Judge Cristiane Farias Rodrigues dos Santos of the 9th Federal Civil Court of São Paulo granted Stake an injunction to operate until 25 October. Luis Antonio Johonsom di Salvo, President of the Federal Regional Court of the 3rd Region (TRF3), suspended the injunction on 9 October.
The licensed market the MP closes is covered in TGE’s report on Brazil’s first regulated year.
Next steps
Banks return player balances between 9 and 14 October, according to Agência Brasil, and Caixa Econômica Federal can intermediate payments that banks cannot make from 14 October. On 10 October, TGE reported that Fux had yet to decide whether to rule alone or send the ANJL and IBJR petitions to the STF plenary. Stake’s case continues before the 9th Federal Civil Court of São Paulo.
The Congress page showed the joint committee of deputies and senators awaiting amendments on 12 October. The urgency regime starts on 9 November, and the deliberation deadline is 23 November.
