Brazil's 85 federal authorisations lapse on 25 October with no refund of the R$30m fee, while the STF ruling and the Congress review are still pending.

All 85 Brazil betting licences issued at federal level expire on 25 October, 30 days after Provisional Measure (MP) 1.394/2026 banned fixed-odds betting nationwide. Each licence cost R$30m, or R$2.55bn in total, and the MP rules out any refund or compensation. Operators now depend on a pending Supreme Court (STF) ruling and a Congress review that has not started.

What expires on 25 October

The MP, signed on 25 September, stopped deposits on publication, closed withdrawals at 23:59 on 5 October and took licensed sites offline on 6 October. The extinction of federal, state and district authorisations on 25 October is the last step, as the STF summary of the first challenge sets out. The five-year licences were granted under Law 14,790/2023, and the MP gives operators no right to recover the fee in full or in part.

What the biggest operators lose

The MP also bans advertising and sponsorship, so clubs had to remove betting brands from kits by 5 October. Kaizen Gaming’s Betano paid Flamengo R$268.5m a year in the largest shirt deal in Brazilian football, valid to 2028; the deal is on hold, and the 2026 instalments were paid by 10 September, Terra reported. Fluminense President Mattheus Montenegro said the club’s Superbet contract is suspended.

Selection: large groups by company disclosures and club deals, not a revenue ranking. Shirt deals at the start of the 2026 season, from Poder360’s January survey; positions from company statements to TGE.

Beyond sponsorship, operators lose their sports betting and online games offer, advertising and local teams. ANJL reported on 7 October that more than 3,500 jobs had gone, and supplier Evolution has closed its Brazil studio.

Court and Congress timelines

Justice Luiz Fux, rapporteur for the challenges including ADI 8,027 filed by ANJL, is expected to rule only after 25 October, Poder360 reported, so the licences lapse first. The joint committee named on 30 September is still awaiting installation, according to the National Congress page for the MP, with 94 of 99 amendments still active.

The MP must be voted by 23 November, extendable once by 60 days, and the recess from 23 December pauses the count. If it is rejected or lapses, legal analysts at Migalhas note, the extinguished authorisations would not return automatically.

Bettor refund bills

PL 5.502/2026, filed by Deputy Ricardo Abrão (PSDB-RJ) on 1 October, would make operators repay each customer’s net losses, not just balances, with claims surviving closure or bankruptcy. Atlas Público shows no procedural step since filing.

On 15 October Deputy Jorge Goetten (Republicanos-SC) filed PL 5.587/2026, which limits refunds to net losses with unauthorised operators and makes banks liable where they failed their checks. Amendment 98 to the MP, from Senator Sargento Reginauro (PSDB-CE), also seeks a refund of losses.

Nobody can say today exactly what comes back, or when.

Next steps

  • After 25 October: Fux is expected to decide on suspending the MP.
  • 9 November: the MP enters the urgency regime in Congress.
  • 23 November: the first 60-day period ends.

TGE is running a written roundtable on the ban with B2B suppliers and B2C operators, moderated by a member of the TGE Advisory Board, and will publish it once all statements are in.
