The case before the STF
Provisional Measure 1,394/2026, published in the Official Gazette on 25 September, prohibits fixed-odds betting in Brazil and ends the authorisations granted to operators. The ANJL challenged it in Direct Action of Unconstitutionality (ADI) 8027, asking the court to suspend the measure and declare it unconstitutional.
Fux, the rapporteur, called the hearing in an order dated 26 October that summoned 26 entities. A second order added the Brazilian Olympic Committee (COB) and the Ministry of Sport. ADIs 8024, 8028 and 8035 challenge the same measure. The IBJR has reported 60,477 illegal betting sites flagged since the ban.
Why the list grew to 34
The AGU asked Fux to widen the panel, arguing that the participants formed “a group predominantly composed of sports entities and representatives of betting operators.” Clubs and betting-sector bodies made up 17 of the 26 entities in the first order.
In his decision of 1 November, Fux added the Ministries of Health and of Justice and Public Security, the Brazilian Association of Supermarkets (Abras), the Brazilian Paralympic Committee, the National Federation of Professional Football Athletes (Fenapaf) and Grêmio. He noted that he had chaired two hearings in November 2024 where groups opposed to legal betting described its social harms.
The social harms of gambling are already known to this Court, and have even been used to support my votes in other judgments on the subject.

The Brazilian Psychiatric Association (ABP), the Alana Institute and the consumer body IDEC took part in the 2024 hearings and are not on the 3 November list.

Next steps
Fux will take the hearing into account before ruling on the ANJL’s request to suspend the measure. As a provisional measure, MP 1,394/2026 must be approved by Congress to stay in force. Read the IBJR’s earlier response to the Brazil betting ban and the Fux hearing.
