Casa de Apostas is back online after a federal appeals court exempted its operator, CDA Gaming Ltda., from the Brazil betting ban and restored the R$30m authorisation it lost under Provisional Measure (MP) 1,394/2026.
Judge Adriana Pileggi de Soveral of the Third Panel of the Federal Regional Court of the 3rd Region (TRF-3) granted the injunction on 3 November 2026, the same day the Supreme Court (STF) held its public hearing on the ban. The order applies to CDA Gaming only. The other federal authorisations that lapsed on 25 October stay extinguished.
Exemption from the Brazil betting ban
The injunction, issued in interlocutory appeal No. 5034200-15.2026.4.03.0000, removes the effects of Article 4 of the MP, which extinguished the federal authorisations, for Portaria SPA/MF No. 255/2025. CDA Gaming paid R$30m for that authorisation, which runs until 31 December 2029 and covers the Casa de Apostas, Betsul and Jogo Online brands.
The judge also lifted the restrictions in Article 7 of the MP and the effects of a Ministry of Justice digital rights letter (Ofício No. 1256/2026) against the company. She ordered its web domains and its operating, financial and payment services restored until the final ruling in its writ of mandamus, under a daily fine of R$200,000.
The 26th Federal Civil Court of São Paulo had refused the company an injunction in the writ of mandamus (No. 5031432-52.2026.4.03.6100), giving priority to the public interest in protecting the population from the harms of betting.
Why the court lifted the ban
The judge found that ending authorisations at such short notice caused “enormous harm” to operators that had invested under rules set by the government itself, and that the MP breached legal certainty, reasonableness and proportionality. She described keeping the R$30m fee with no refund or compensation as “a true confiscation” (translated from Portuguese). Under the text of MP 1,394/2026, operators get no full or partial refund of the fee.
Also absent are relevance and urgency (Article 62 of the Constitution).
Adriana Pileggi de Soveral, Federal Appeals Judge, Federal Regional Court of the 3rd Region (TRF-3), in the decision of 3 November 2026 (translated from Portuguese)
Article 62 of the Constitution allows the President to legislate by provisional measure only in cases of relevance and urgency. Licensed operators made the same argument at the STF hearing, where several speakers asked why a market regulated under Law 14,790/2023 needed to be closed by an MP, as operators told the STF.
Back online
The Casa de Apostas site at casadeapostas.bet.br was open to registered players on 5 November, behind an age check. Betsul’s site showed a legal notice stating that the brand is operated by CDA Gaming and that its SPA authorisation was provisionally restored by the TRF-3 in case No. 5034200-15.2026.4.03.0000.

Licensed betting sites went offline from 6 October, after President Luiz Inácio Lula da Silva signed the MP on 25 September. The 85 federal authorisations lapsed on 25 October.
Next steps
The court summoned the National Secretary for Digital Rights, the National Secretary of Public Security, the Secretary of Prizes and Bets (SPA) at the Ministry of Finance and the President of the Central Bank to respond within 15 days under Article 1,019, II of the Code of Civil Procedure. The injunction stands until the writ of mandamus is decided or another court order replaces it.
In Congress, the MP blocks the agenda from 9 November and its first 60-day term ends on 23 November; the government wants a vote by 20 December, according to its timetable. At the STF, Justice Luiz Fux closed the 3 November hearing without a ruling or a date for judging the challenges to the MP.
